EPA v. 1033 Kings Highway, LLC
Final Order With Unspecified Cost Recovery
Case summary
The current owner of the American Candle facility signed an Administrative Settlement Agreement and Order on Consent to perform Removal Action at this facility. Under this Agreement and Order, the PRP has performed a removal of hazardous substances, pollutants and contaminants from the vacant, 41.5-acre facility, thereby mitigating an imminent and substantial endangerment to human health and the environment. The removal work under the Agreement and Order was completed under EPA oversight on or about September 5, 2007. EPA is entitled to recover its response costs (mainly in the form of oversight costs) from this PRP under the Agreement and Order, but has not yet quantified or billed for these costs. There are no other viable PRPs at this Site.
