As such, Region 2's dry cleaner small area source penalty policy was used to calculate the penalty for the alleged violations. In an effort to promptly settle this matter, both the Administrative Complaint and CAFO were part of one package sent to the facility and EPA proposed to reduce the penalty of $1172 by 50% to $586 if the company signed the enclosed CAFO within 20 days of receipt. In ensuing settlement discussions, the respondent agreed to sign the CAFO and pay the reduced penalty. The respondent returned the signed CAFO to EPA within the required 20 days and no further action is required.
