Case summary

On May 12, 2009, a Consent Decree was entered in U.S. District Court for the Northern District of New York between the United States on behalf of EPA and Laquidara Construction, Inc. and Peter V. Laquidara (the Laquidara entities), to resolve claims against them pursuant to Section 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act in connection with a removal response action performed by EPA at the Saratoga Radar Station Site, Town of Stillwater, Saratoga County, New York. This Consent Decree settlement also includes several Federal parties, the “Settling Federal Agencies,” namely the United States Department of Defense including the Department of the Air Force, Army Corps of Engineers and the Federal Aviation Administration. The Laquidara entities settled on an ability to pay basis and the Consent Decree obligates the Laquidara entities to pay to the United States, in three equal installments (plus interest). The Consent Decree also provides for the Settling Federal Agencies to pay to the EPA Hazardous Substance Superfund.
