Case summary

The Facility, a bakery that emits large amounts of volatile organic compounds (VOC), is owned/operated by the Defendant. The Facility currently operates in violation of emission limits set forth in the federally-enforceable New Jersey State Implementation Plan (SIP), and incorporated into the Facility title V operating permit, for the control of VOCs by operating reasonably available control technology (RACT). Following a notice of violation issued by EPA, the Defendant has agreed to install control technology it claims will result in compliance with the SIP, and the requirements that are in the title V operating permit. The Defendant will also pay a civil penalty.
