Case summary

Requesting representation against the Defendants. The purpose of the representation is to direct the Defendant to create and implement an SPCC PLan at the facility and pay penalties. Region 2 had filed an administrative action against the Defendant on September 24, 2004, for violations of Section 311(j)(1)(C) of the Clean Water Act. The Respondent did not file an answer to EPA's Administrative Complaint for failure to implement an SPCC Plan. A second inspection was performed on April 25, 2006 by the same EPA inspector who performed the initial inspection in 2004. The second inspection confirmed that the Defendant made no attempt to comply with the SPCC regulations. Amended complaint filed August 19, 2010. Defendant claimed name of entity was incorrect. Complaint reflects name change, although initial name was in fact correct. Memorandum Order entered on March 1, 2012, ordering Defendants pay a civil penalty.
