EPA v. City of Middletown
Final Order With Penalty
Case summary
The City violated a previously issued by failing to meet the notice to proceed milestone. The AO was issued to address the system's noncompliance with the IESWTR (by failing to monitor individual filter effluent) and comply with turbidity standards and the Stage 1 DBPR (by failing to comply with the MCLs for TTHM and HAA5). The consent decree establishes an enforceable schedule to design, build and operate a filtration plant. Injunctive relief includes the cost to design and construct the water treatment plant. The consent decree also includes a civil penalty and requires the implementation of a SEP.
