Case summary
1) This order is being issued for violations the Administrative Order (Docket No. SDWA-02-2006-8001) issued by the EPA on October 13, 2005. The Respondent violated the Administrative Order (Docket No. SDWA-02-2006-8001) by violating a treatment technique requirement of 40 CFR Part 141, Subpart H, Surface Water Treatment Rule. The treatment technique violation occurred upon start-up of the Catskill Aqueduct which caused an exceedance of the 5 NTU turbidity limit on March 23, 2006. 2) Based on the PWSS penalty calculations, which weigh population heavily, we are seeking the statutory maximum penalty of $27,500.
