Case summary
This order is being issued for violation of 40 CFR Part 141, Subpart H, Surface Water Treatment Rules Stormwater runoff from construction spoils near the Kensico Reservoir intake cased an exceedence of the 5 NTU turbidity limit. This AO requires the City to develop and implement enhanced practices for City-controlled construction projects at or near reservoir intakes ofthe Catskill/Delaware water supply to prevent a recurrent exceedence of the 5 NTU turbidity limit. In addition, the City monitors for turbidity without the required EPA/NYSDOH approved protocol for validating results. This order requires the City to formally submit a proposed protocol for validating the continous turbidimeters for accuracy on a regular basis.
