Case summary
The facility was issued field citation II-UST-FC-1035, in the amount of $1,050, for the following violations: 40 CFR 280.21(d): failure to provide overfill prevention system; 280.31(b): failure to ensure proper operation of cathodic protection system; 280.45: failure to maintain records of release detection monitoring; failure to conduct annual test of the operation of automatic line leak detectors; and 280.41(b)(1)(ii): failure to have annual line tightness test of pressurized piping. Immediately following the inspection, the facility's contractor determined that the UST in question was not lacking overfill prevention. Because of this, the first violation was removed and the penalty was reduced to $750. To address the violations, the facility spent $2,100 to repair--and subsequently test--the cathodic protection system of its motor oil tank, and spent $1,345 on ALLD and line tightness testing. Since the release detection monitoring violation was just a record keeping violation, the facility did not incur any costs to address this violation.
