Case summary

The Respondent owns two separate solvent-based dry cleaning establishments, one located in Armonk, NY and the other in Thornwood, NY. RCRA compliance evaluation inspections of both 'Dry Cleaning by Fredericks' facilities revealed multiple violations of Small Quantity Generator regulations at each site, including operating a storage facility without a permit or interim status by not complying with most requirements for generators of hazardous waste (storage, labeling, recordkeeping, emergency preparation and prevention), failing to make a hazardous waste determination (at the Thornwood facility), and failure to minimize the possibility of releases of hazardous waste, particularly at the Thornwood site where the facility was operating an evaporator/mister device designed to treat perchloroethylene-contaminated separator water, without properly maintaining this equipment. In addition, many of the violations observed during the initial inspection of these facilities were, again, found at the Thornwood facility during subsequent inspections despite the issuance of informal enforcement actions and of compliance assistance material, and despite submittals by the Respondent indicating that these violations have been corrected.
