Case summary
Empresas Chipi, Inc. violated Section 301 of the Act, 33 U.S.C. §1311 for discharging raw sewarge (pollutants) into the Gurabo river. On May 17, 2006, EPA found the Laderas de Juncos Pump Station bypassed. Upon receipt of the, the Empresas Chipi shall cease and desist the discharge of pollutants into the Gurabo River, a water of the United States. If the pump station is unable to operate, the Empresas Chipi shall transport any sewage from the pump station, to an authorized PRASA wastewater treatment plant. Immediately upon receipt of the, the Empresas Chipi shall repair and/or replace, unclog and clean the pump station and all sewer pipelines that are causing sewer overflows at the Laderas de Juncos pump station. Within 30 calendars days of receipt of the order, the Empresas Chipi shall complete the permanent repairs to the pump station and its tributary sanitary sewer collection system to permanently prevent sewage overflows from reoccurring. The pump station shall be capable of operating in both automatic and manual modes, at all times. Within thirty 30 calendar days of the receipt of this ORDER, Empresas Chipi shall implement, a Preventive Maintenance Program (PMP).
