Unilateral Administrative Order Without Adjudication

Case summary

As a result of EPA's inspection on June 13, 2005 and the DMRs from August 2004 through August 2005,evaluation of PRASA's reports and other information, EPA found that PRASA violated the permit by its failure to: (1) provide adequate operation and maintenance; (2) take affirmative actions to terminate the violations of the permit; and (3) timely bring the facility into compliance with the Act. Immediately upon receipt of the ORDER, PRASA shall maximize the Operation and Maintenance at the facility in order to achieve and maintain compliance with the facility�s final effluent limitations set out in the permit. Within thirty (30) calendar days of receipt of the ORDER, PRASA shall submit a compliance plan to EPA that outlines a schedule, for the completion of all the permanent repairs needed to correct the deficiencies found at the Yauco WWTP during the June 13, 2005 CEI. The schedule shall not contain dates beyond one hundred and eighty (180) calendar days of receipt of the ORDER. All the treatment modules, pumps, controllers, mechanical and electrical equipment, including, but not limited to, switches, float controllers, alternate power generators, lighting and safety equipment should be in full operational condition. Within one hundred and ninety (190) calendar days of receipt of the ORDER, PRASA shall submit a certification to EPA stating that PRASA complied with the Order Provisions.
