Unilateral Administrative Order Without Adjudication

Case summary

Based upon information gathered by EPA during the June 27, 2005 CEI and the DMRs from August 2004 through June 2005, EPA finds that PRASA is not in compliance with its NPDES permit. The facility has not been adequately operated and maintained as required by the permit. As a result of EPA's inspections and evaluation of PRASA's reports and other information, EPA found that PRASA violated the permit by its failure to: (1) provide adequate operation and maintenance; (2) take affirmative actions to terminate the violations of the permit; and (3) timely bring the facility into compliance with the Act. Immediately upon receipt of the ORDER, PRASA shall maximize the Operation and Maintenance at the facility in order to achieve and maintain compliance with the facility�s final effluent limitations set out in the permit. Within thirty (30) calendar days of receipt of the ORDER, PRASA shall submit a compliance plan to EPA that outlines a schedule, for the completion of all the permanent repairs needed to correct the deficiencies found at the Mayag�ez RWWTP during the June 27, 2005 CEI. The schedule shall not contain dates beyond one hundred and fifty (150) calendar days of receipt of this ORDER. All the treatment modules, pumps, controllers, mechanical and electrical equipment, including, but not limited to, switches, float controllers, alternate power generators, lighting and safety equipment should be in full operational condition. Within one hundred and sixty (160) calendar days of receipt of the ORDER, PRASA shall submit a certification to EPA stating that PRASA complied with the provisions of the ORDER.
