Case summary
Based upon information gathered by EPA during the June 10, 2005 inspection, PRASA�s bypass notifications sent to EPA on 4/12/05,4/27/05,5/16/05,5/17/05,6/22/05,8/01/05,9/07/05, and the DMRs from June 2004 through June 2005, EPA finds that the Yabucoa WWTP is not in compliance with its NPDES permit. The facility has not been adequately operated and maintained as required by its NPDES permit. Immediately upon receipt of the ORDER, PRASA shall maximize the Operation and Maintenance in order to achieve and maintain compliance with the facility�s final effluent limitations. PRASA shall provide specific training to the facility personnel about the criminal aspects of falsifying or tampering information, as established in the Clean Water Act. PRASA shall repair/replace or make fully operational, all the deficiencies identified in the findings of the ORDER. PRASA shall submit a certification to EPA stating that all required repairs/replacements identified in ordered provision numbers 3 and 4 have been made to the facility and are capable of full operation. Within one hundred and eighty (180) calendar days of receipt of the ORDER, PRASA shall conduct a comprehensive sanitary sewer system evaluation survey to identify significant infiltration/inflow problems in the system which may be the caused of flow exceedance violations, as frequently reported in the facility DMRs. The evaluation shall include the identification of any cross connections between the sanitary and storm sewers. Within thirty (30) calendar days of the completion of the evaluation, PRASA shall submit a plan to EPA that outlines a schedule, for the necessary repairs and/or field work in the system. The schedule shall identify specific tasks and timeframes for the completion of all necessary works.
