Case summary

Respondent is a corporation organized under the laws of the Commonwealth of Puerto Rico and is the developer of Parque de Las Flores Housing Development and constructed the Parque de Las Flores pump station and its associated sewage collection system. During July 12 and 13, 2001, August 10, 2001, March 25, 2003, June 22, 2004 and June 29, 2004, raw sewage was being discharge from a 8-inch sewer pipeline located at Parque de Las Flores Housing Development, into the Coamo river. The pipeline is part of the Parque de Las Flores Housing Development sanitary collection system. The Coamo river is a water of the United States, within the respective definition established in Section 502 of the Act, 33 U.S.C. 1362. The evidence was obtained by EPA through the Puerto Rico Environmental Quality Board inspection reports. Respondent has violated Section 301(a) of the Act on 6 instances for the unauthorized discharge of pollutants into waters of the United States.
