Case summary

This is an Administrative Settlement Agreement and Order on Consent signed on September 29, 2005 that provides for the performance of a removal action at the New York Environnmental Recovery Group Site in Fort Edward, New York. (This Agreement was issued under Sections 104, 107 and 122 of CERCLA.) The Respondent to the Agreement contracted with the Site operator, New York Environmental Recovery Services, Inc. (NYERS) for the treatment and/or disposal of regulated asbestos-containing material (RACM) removed from the Respondent's Corinth, New York, facility. The RACM came to be located at NYERS place of operations at One Liberty Street in Fort Edward. NYERS is defunct and the owner of the Site property is deceased. Under the Agreement, the Respondent will remove and dispose of RACM located within a building and four trailers at the Site, as well as remove other materials at the Site which contain hazardous substances, such as drums, tanks, aerosol cans, and other containerized items. The Agreement also calls for the reimbursement of response costs incurred by EPA in overseeing Respondent's implementation of the cleanup work.
