Case summary
On September 15, 2004 and September 20, 2004, an EPA inspector and New Jersey Department of Health & Senior Services inspectors conducted an inspection at the facility. Respondents violated 40 C.F.R. Part 61, Subpart M by failing to submit a 10-day nofication of intent to demolish and failing to properly remove and contain asbestos containing materials at the inspected Facility. CCDS: On September 12, 2005 EPA issued a Complaint against Respondents for violations of the asbeston NESHAP, including failures to 1)notify EPA prior to demolition; 2) remove all RACM priior to demolition; 3) maintain RACM wet until disposal; and 4) have someone present on-site that is trained in the provisions of the asbestos NESHAP.
