EPA v. Westwood Chemical Corp.

Case summary

On March 2, 2005, EPA initiated performance of a time-critical removal action pursuant to CERCLA at the Westwood Chemical Site (ýSiteý). The Site is the location of a former manufacturing plant owned and operated by Westwood Chemical Corp. (ýWestwoodý). EPA presently anticipates that it may incur up to $2.7 million in performance of the CERCLA removal action at the Site. As a result of financial difficulties, Westwood ceased operations in October 2004 resulting in the abandonment of hazardous substances which have been released and which threaten to continue to be released at and from the Site. On January 28, 2005 Westwood Westwood was put into a Chapter 7 bankruptcy. By this referral, EPA requests that DOJ appear in the bankruptcy on behalf of EPA in order to recover the costs of the performance of the CERCLA response action from the bankruptcy estate.
