Case summary

This facility was issued a Complaint in September of 1997 for failure to comply with release detection and closure requirements at its facilities in the Commonwealth of Puerto Rico. EPA and Complainant executed a CA/CO in February , 1999. The Respondent paid a civil penalty of $80,000.00 and agreed to perform a SEP involving the installation and operation of Automatic Tank Gauging on 35 USTs at 14 Sites. Respondent failed to perform the SEP at eight of the facilities identified in the CA/CO and also failied to complied with closure requirements. Respondent has since completed the SEP and is on a compliance schedule for the closure requirement and a penalty of an additional $15,000.00.
