Case summary

Facility was inspected on March 4 and 5, 2003 to investigate the distribution or sale of alleged misbranded pesticide products by Respondent. During the inspection, invoices were collected showing the facility purchased large quantities of eight different misbranded pesticide products from various domestic and foreign vendors. Additional evidence was collected showing that the facility stored these illegal pesticide products in its warehouse and subsequently distributed them to the facility's seventy-seven (77) retail stores located in the eastern and mid-western United States. As requested at the inspection, the facility returned to the vendors the remaining stock of all eight products in the warehouse and at the retail stores. The facility went bankrupt and the ca/fo was issued with no penalty.
