Case summary

EPA seeks to recover costs incurred performing response actions at the Bayonne Barrel and Drum Site. The settling parties have agreed to reimburse EPA's past response costs in two installment payments. A third payment is due within 540 days of the effective date of the agreement, but it is subject to reduction or even forgiveness in the form of an orphan share credit that will be calculated based on the value of work that the settling parties are currently performing at the Site, and additional work that they are expected to perform in the future. The settling parties are expected to enter into a final settlement with respect to the Site, to perform additional work, within 540 days of the effective date of this agreement.
