Case summary
The ex-Michelin Facility is located on the southern side of Ford Avenue at 2-130 Ford Avenue, Milltown, Middlesex County, New Jersey. It is approximately 19.5 acres in size. It consists of numerous structures associated with former industrial operations that were conducted there in the mid-1900s. During a visit to the Building 13 on December 3, 2003, EPA officials observed numerous drums in the building that were rusting badly and were of poor integrity. Some of the drums were labeled flammable or highly flammable and some of the drums contained hazardous substances including, but not limited to, lead, asbestos and polychlorinated biphenyls. On several occasions, beginning from December 30, 2003, EPA requested the Respondent voluntarily consent to EPA entering and performing certain response actions at Block 58, Lot 1.03. Respondent was asked to sign and return an access agreement to EPA. The Respondent did receive EPA's requests for access. EPA, however, has not received any response from the Respondent to date. Because Respondent failed to respond to EPA's requests for access, it has become necessary to issue this UAO.
