Case summary

On July 14, 2004, Region 2 issued an Administrative Order on Consent (AOC) to two corporate parties, requiring them jointly and severally to perform a time-critical removal response action at the Robinson/Fiddlers Green Superfund Site, Erie County, NY pursuant to Section 106(a) of the Comprehensive Environmental Response, Compensation, and Liability Act. The Site, which is not listed on the National Priorities List, includes a former manufacturing facility where each of the respondents previously manufactured kitchen utensils, including cutlery and plastic food preparation tools. Each respective respondent has since moved from the Site leaving behind numerous drums and other containers of waste oils and other wastes which are still present at the Site. Previous opearations also resulted in contamination of soils at the Site and contamination in and around machinery. The removal action which is the subject of the AOC will address the containerized wastes, the soils and the contamination around the machiner at the facility.
