In 2007, EPA again initiated action against the Defendant - concerning CWA violations at the Facility. Defendant failed to comply with 1) the CAA by failing to properly perform compliance testing, by exceeding emission limits, and by failing to properly monitor emissions at the Facility and 2) the CWA by not complying with effluent limits, not properly preparing required compliance plans, not maintaining records, not submitting timely reports, not operating pursuant to a permit, and not complying with its compliance plan. CD combined this case with another and became a multi-media action: EA# 02-2007-0013 combined with EA# 02-2004-0026.
