EPA v. Schifano Construction
Final Order With Penalty
Case summary
The facility was originally inspected on May 10, 2002, at which time the facility was not able to provide much information regarding the management of their USTs. In order to obtain the necessary compliance information, EPA issued the facility a 9005 Information Request Letter in July 2002. Based on the facility's responses to the Information Request the EPA determined that the facility failed to comply with the following two requirements: 280.45: failure to maintain records of release detection monitoring; and 280.93(a): failure to comply with financial responsibility requirements. On November 4, 2002, EPA issued Field Citation II-UST-FC-524 in the amount of $300 to Schifano Construction. Prior to issuance of the Field Citation, the facility had already corrected the violations.
