Case summary
This is a consolidated action pursuant to our Consolidated Rules of Practice (40 C.F.R. �22.18(b)(2) and (3)), which provide that a proceeding may be simultaneously commenced and concluded by the issuance of a Consent Agreement and Final Order (CAFO) when the parties agree to settle one or more causes of action before the filing of an Administrative Complaint. We settled this case in this manner. On August 28, 2002, Anadigics, Inc. disclosed possible violations to the U.S. Environmental Protection Agency (EPA) pursuant to EPA�s Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations, 65 FR 19618, April 11, 2000, commonly referred to as the Audit Policy. The disclosure indicated that Anadigics, Inc., located at 141 Mount Bethel Road, Warren, New Jersey 07059, discovered that it may have failed to file Form R reports in a timely manner for chloroform for calendar years 1997, 1998, 1999, and 2000. The Form R reports were submitted to the EPA on September 23, 2002. The failure to submit in a timely manner complete and correct Form R reports constitutes a failure to comply with Sectipon 313 of EPCRA (42 U.S.C. �11023), and with 40 C.F.R. �372.30.
