Case summary
EPA has determined the proposed penalty of $101,290 against the Puerto Rico Aqueduct and Sewer Authority concerning the Aibonito Wastewater Treatment Plant for failure to meet effluent limitations set forth in the National Pollutant Discharge Elimination System (NPDES) permit, for the unlawful discharge of untreated or partially treated sewage (wastewater bypasses) into the Aibonito River, navigable waters of the United States, and failure to provide proper operation and maintenance to the plant, all against the NPDES permit. The violations taken in the Complaint occurred within the period of May 1, 2001 and August 31, 2002. This case was settled together with 10 other cases in one CA/FO. SEP to implement Phase I of the Watershed Stewardship Program, pursuant to a Memorandum of Understanding signed on February 26, 2004, EA# 02-2004-3401.
