Unilateral Administrative Order Without Adjudication
Case summary
The Municipality of Catano ( MC ) have violated the CWA by discharging pollutants into Cano La Malaria, a water of the US, without a permit to do so. In addition, MC did not comply with the ordered provisions of the Administrative Order CWA-02-2001-3024, issued on January 12, 2001. With this Order (CWA-02-2003-3019) EPA is requring MC to immediately ease and desist the discharge of pollutants, to repair and/or replace, unclog and clean allsewer pipelines and manholes that are causing overflows of sewage at the Puente Blanco sanitary system. Within 90 days of the receipt of the Order, MC has to submit to EPA a certification that all required repairs/replacements were made.
