EPA v. Honeywell International Inc.
Final Order With Unspecified Cost Recovery
Case summary
PRP will perform an RI/FS (Operable Unit 2) at the Quanta Resources Superfiund Site in Edgewater, NJ. Operable Unit 2 consists of Hudson River sediments. Work will be performed pursuant to an administrative order on consent. Under the Order PRP will reimburse EPA for oversight costs. On May 29, 2018, Region 2 and the Respondent executed an amendment to the RI/FS Administrative Order on Consent for the Hudson River portion of this Site (operable unit 2), which provides the parties the option of performing an EE/CA (engineering evaluation/cost analysis) if EPA determines that a removal action is appropriate, and a planning period of at least six months exists before on-site activities must be initiated. EPA has determined that a non-time critical removal action (NTCRA) is needed to address the nearshore contaminated sediments, necessitating an EE/CA, something the Order on Consent did not contemplate. Implementation of the NTCRA will be addressed by a future order.
