EPA v. John T. Sweeney et al.

Final Order With Specified Cost Recovery

Case summary

Metal galvanizing operations conducted at this Site from at least 1967 through 1994 resulted in the release at and from the Site of process wastes. EPA performed a removal response action at the Site from September 1999 through the Spring of 2000. The settling parties include an individual who operated the Site and two privately held corporations that, respectively, owned and operated the Site and that were owned and controlled by the individual settling party. The settlement provides for the reimbursement to EPA of past costs incurred by EPA in performance of this removal action. The facility had been the subject of a previous Superfund removal action in 1991 which addressed similar wastes and which was performed by the same parties under an administrative order on consent. The facility is no longer in operation. Upon implementation of this settlement, the settling parties will have paid more than 90% of the costs of the removal actions at the Site.
