Case summary
Request that DOJ file an application for adminstrative expenses and a proof of claim for EPA response costs. Amendment to an existing bankruptcy matter made on September 30, 2003. On February 3, 2004, EPA requested DOJ include in the proof of claim an unpaid RCRA penalty from a Consent Agreement, Docket #RCRA-02-2001-7106. Stipulation and Order entered into by the United States and the trustee in the Diaz Chemical Corporation bankruptcy, whereby the trustee agreed to pay from the estate for EPA response actions at the Site.
