Case summary
Defendant is successor to the previous owner/operator of the Magic Marker/Gould Battery Site. EPA performed a removal action at the Site in 1998, and has a cost recovery claim. Defendant has filed for Chapter 11 bankruptcy protection and EPA is asking DOJ to file a proof of claim in the matter. Region 2 did not participate in the settlement. Already settled our claim against the Defendant's predecessor (Gould Electronics, Inc.) in 2007 and stipulated that if Gould paid, Region 2 would withdraw the proof of claim against the Defendant - EA# 02-2001-0005.
