Case summary
'40 CFR Subpart H requires public water systems using a surface water source to install filtration, unless the system can meet the avoidance criteria outlined in 40 CFR Section 141.71(a)(b). On February 29, 2001 EPA issued an Administrative Order (AO) to the PRASA Veguita System (Respondent) for failure to comply with the filtration requirements of the SDWA. The AO required Respondent to either filter or eliminate the Veguita public water system by January 15, 2002. On September 9, 2002, EPA issued this complaint and notice of proposed assessment of a civil penalty and opportunity to request a hearing when respondent failed to comply with the AO.'
