Case summary

RESPONDENT'S UST SYSTEMS FAILED TO MEET CLOSURE, RELEASE DETECTION RECORD KEEPING, AND CATHODIC PROTECTION TESTING REQUIREMENTS. THE COMPLIANCE ORDER REQUIRES THAT RESPONDENT SUBMIT RELEASE DETECTION RECORDS AND RECORDS DOCUMENTING PERMANENT CLOSURE OF NONCOMPLIANT USTS. CCDS: EPA conducted a multi-media inspection of Princeton University (Respondent) on June 26, 2001, in which the UST program participated. The UST program was the only one which pursued enforcement; making this a single-media action. The following violations were noted during the inspection 280.45(b): failure to maintain one year of release detection records; 280.44(a): failure to conduct an annual test of an automatic line leak detector; 280.70: failure to permanently closure or upgrade a temporarily closed tank system after 12 months; and 280.31: failure to ensure proper operation of a cathodic protection system. In March 2002 EPA issued a Complaint, Compliance Order, and Notice of Opportunity for Hearing to Respondent, in the amount of $30,957.50, for the above mentioned vioolations. Respondent has agreed to settle this case by correcting all the violations and paying a penalty of $21,470 (which is a 30% reduction from the original penalty).
