'An Administrative Complaint and Consent Agreement & Final Order was issued simultaneously in the same document. A review of the Toxic Release Inventory Envirofacts Database indicated that the Respondent voluntarily submitted to the EPA on July 28, 2000 a late TRI Form R (Form R) for ylyene (mixed isomers) for reporting year 1998 which was more thatn a year late and late Forms R for 4,4 -methylene(chloroaniline) for reporting years 1997 and 1998. On May 17, 2002, a letter addressing the above late reporting violations was sent to the company in an effort to gain more insight into the circumstances concerning the above violations. On June 27, 2002, Cytec Industries Inc. provided the requested information on behalf of Cytec Olean Inc. Based on this information, it was determined that Cytec Olean Inc. has processed (as definined in 40 CFR Section 372.3) approximately 26,532 pounds of xylene (mixed isomers) during 1998, 53,196 pounds of 4,4''-methylene(chloroaniline) during 1997 and 60,888 pounds of 4,4''-methylene(chloroaniline) during 1998 and that the Respondent was required to submit 1997 Form Rs by July 1, 1998 and 1998 Form Rs by July 1, 1999 to the Administrator of EPA and to the State of New York. THis failure to submit the Form Rs, in a timely manner constitutes a violation of Section 313 of EPCRA, 42 USC Section 11023, and 40 CFR Section 372.30.'
