'ON NOV 23, 1999, CIBA SUBMITTED A WRITTEN AND SIGNED STATEMENT OF VOLUNTARY DISCLOSURE TO EPA, STATING THAT THEY HAD FAILED TO FILE FORM R REPORTS FOR CERTAIN GLYCOL ETHERS FOR 1996-1998. RELIEF UNDER AUDIT POLICY WAS DENIED BECAUSE CONDITION D1 WAS NOT MET AND AN ADMINISTRATIVE COMPLAINT WAS ISSUED. Case Conclusion Data Sheet case summary: On Nov. 23, 1999, Ciba voluntary disclosed to EPA that they had failed to submit complete and correct form R reports for certain glycol ethers for the years 1996-1999 for their Old Bridge facility. EPA reviewed the disclosure and penalty mitigation was only partially granted because Ciba failed to meet all the conditions required under the Audit Policy. An administrative complaint was issued for $56,100 on March 28, 2002. A telephone settlement conference was held between EPA and Ciba on May 1, 2002. EPA offered a 75% penalty reduction and a settlement figure of $14,025 was reached. The CA/FO was signed by the RA on June 20, 2002.'
