Benbow did not submit the requried Tier I or Tier II forms to the State Emergency Response Commission ( SERC ), Local Emergency Planning Committee ( LEPC ), and the local fire department with jurisdiction over the Facility with the timeframe set by EPCRA. EPA and Benbow agreed to a settlement valued at $18,626. Under the CA/FO, Benbow will implement a Supplemental Environmental Project ( SEP ) valued at $13,603.18 and pay a monetary civil penalty of $5,022.82 to settle its EPCRA Section 312 violation. This case was initiated and concluded with the same document, the Consent Agreement and Final Order executed on 9/26/2002.'
