Case summary
The Site, which is located in a residential area, has been used by Respondent since approximately 1980 for metal salvage operations. EPA initiated a removal action at the Site in February 2001 which involved the excavation and removal of soil contaminated with lead and other hazardous substances and disposal of numerous automobiles and auto parts. The removal action was completed in October 2001 and EPA incurred nearly $800,000 in cleanup costs. EPA representatives noted evidence of continued metal salvage operation on-Site during and after the removal action despite repeated requests by EPA representatives for Respondent to cease such activities. The UAO orders Respondent to immediately refrain from the smelting of lead or any other metal; the improper handling and disposal or storage on-Site of motorized vehicle batteries, vehicle tires and associated lead tire weights, waste oil or any other waste fluids from motorized vehicles, or wire or cable; and any other activities at the Site that may cause a release of hazardous substances. Additionaly, Respondent must give EPA and the Puerto Rico Environmental Quality Board access to the Site to ensure compliance with the UAO.
