On August 28, 2002, Anadigics, Inc. submitted a written and signed statement of voluntary disclosure to EPA, stating that they had failed to file EPCRA Form R Toxic Release Inventory Reports for chloroform for calendar years 1997,1998, 1999 and 2000 and for n-methyl-2-pyrrolidone for calendar years 1999 and 2000. The Form R reports were submitted to the EPA on September 23, 2002. Upon review, it was determined that Anadigics, Inc. did not meet Condition D.1 of the Audit Policy, Systematic Discovery. However, the disclosure did meet all the remaining conditions. On February 27, 2003, a Notice of Determination, documenting EPA�s decision on this disclosure was issued. A CAFO, offering a 75% gravity based penalty reduction for the violations, as provided as allowed under the Audit Policy was enclosed. Anadigics, Inc. signed the CAFO on March 13, 2003, agreeing to settle the matter with a $28,050 penalty.
