Fansteel filed for protection under the bankruptcy code many years ago, and as such they did not participate in any of the many settlements which occurred at the Li Tungsten Site. At the time of its filing for bankruptcy, the United States, on behalf of EPA and other federal agencies, filed a proof of claim for claims regarding its liability relating to many facilities, one of which was the Li Tungsten Site.
