AS PART OF THE SETTLEMENT FOR THE VIOLATION THEY AGREED TO PERFORM A SEP TO DISPOSE OF THREE PCB TRANSFORMERS IN LIEU OF PAYING A PENALTY OF $16,500. THE TOTAL COST OF THE SEP NOT INCLUDING THE COST OF REPLACING THE TRANSFORMERS IS $66,810.00. EPA HAS AGREED TO REDUCE THE PENALTY AS A RESULT OF THE SEP TO $4,125.00 ********** In a settlement of a PCB Enforcement Action against the Jamestown Board of Public Utilities on 12/10/01, the utility had agreed to perform an SEP. The SEP was for the removal of 3 PCB transformers, at a cost of $66,810, from the power generating station at Jamestown, NY. As a result, the penalty was reduced from $16,500 to $4,125 or $12,375 with a recovery by EPA of any fraction of the $12,375 penalty reduction for funds not spent on the SEP. In a report by the utility, it was learned they actually spent $27,221.61 in performing the SEP. As a result, EPA recovered an additional $7,332.83 in penalty ($66,810 - $27,221.61 / $66,810 X $12,375). Therefore, the assessed penalty amount is being revised from $4,125 to 11,457.83 (rounding to $11,458). The value of the SEP is now revised from $66,810 to $27,221.61. 11/03/2003 JD **********
