04/11/01 - AUDIT POLICY DISCLOSURE DATE (TWO FACILITIES). CCDS: There are two resolutions to this voluntary disclosure. On April 11, 2001, Chautauqua submitted two written and signed statements of voluntary disclosure to EPA on behalf of Chautauqua Hardware Corporation ( Chautauqua )., stating that the 31-35 Water Street and 243 Hopkins Street facilities determined that they may be subject to additional reporting requirements under EPCRA. Based on information provided by Chautauqua, and that the voluntary disclosure came after EPA had started a review of the 31-35 Water Street facility TRI data, we issued an Administrative Complaint (Docket No. EPCRA-02-2002-4211) on September 11, 2002 for the 31-35 Water Street facility. In reviewing the information for the 243 Hopkin Street facility, EPA determined that they had failed to file Form R reports for cooper for 1998 and 1999 in a timely manner. EPA also determined that the facility meet the Audit Policy criteria and therefore issued to them a Notice of Determination (issued under AP-2002175, originally assigned EPCRA -02-2001-0843) on September 25, 2002.
