Case summary

Settlement resolves underground storage tank violations at 27 facilities owned or operated by 25 Defendants. Violations included failure to upgrade, failure to assess structural integrity of tanks, failure to test cathodic protection systems within 6 months and every 3 years, failure to inspect the impressed current cathodic protection system every 60 days, failure to have release detection, failure to temp close, failure to permanently close, failure to assess site at closure, and failure to meet financial responsibility requirements. Facilities now in compliance and required to submit periodic reports for 5 years to demonstrate continuing compliance. Defendant required to pay a civil penalty in installments. In March, 2011, EPA entered into another agreement with the Defendant to pay stipulated penalties for noncompliance with the Consent Judgment.
