THIS IS A COLLECTION REFERRAL RECOMMENDING THAT IT BE FILED BY DOJ WITH THE UNITED STATES BANKRUPTCY COURT FOR THE DISTRICT OF NEW JERSEY RELATING TO THE OBLIGATION OF FARLEY TO PAY A CIVIL PENALTY PURSUANT TO A CONSENT AGREEMENT AND CONSENT ORDER ENTERED BY EPA AND FARLEY, WHICH WAS APPROVED BY THE BANKRUPTCY COURT IN ADVANCE. * 09/30/97 - REFERRED TO DOJ. * 01/09/98 - COMPLIANT FILED * 06/30/01 NO SETTLEMENT ENTERED TO DATE. Region 2 initiated a collection action against Farley Environmental Co., Inc. to collect a $1000 civil penalty (enforcement #02-1995-0383) and a $6000 stipulated penalty plus interest. Farley filed a bankruptcy petition on Oct. 30, 1995. On January 23, 1997, in response to a settlement entered between Farley and EPA, the Court entered an order whereby Farley was authorized to pay $1000. Proof of claim filed on January 9, 1998. $7,041.10 written off 11/30/2005.
