DEFENDANT OPERATES A PETROLEUM REFINERY WITH TWO OUTFALLS WHICH DIRECTLY DISCHARGE INTO WATERS OF THE UNITED STATES, A PROCESS WATER OUT FALL AND A STORM WATER OUTFALL. DEFENDANT HAS VIOLATED ITS NPDES PERMIT FOR BOTH OUTFALLS, AND THIS ACTION ALLEGES SUCH VIOLATIONS FROM JUNE 1989 TO JANUARY 1993. COMPLAINT COVERS 2 OTHER CASES. THEY ARE: 02-1993-0096 AND 02-1993-0153. This is a multi media action against CPR alleging violations of underground stroage tanks requirements, RCRA financial assurance requirements and violations of its NPDES permit. There is no penalty herein as this was the subject af an earlier consent decree entered 3/13/03. CPR is required to perform any necessary post closure requirements, comply with underground storage tanks regulations and comply with its NPDES permit.
