Case summary

On August 14, 2026, the Region issued an Administrative Compliance Order to the Town of Amherst for their failure to complete and implement a written Lake Phosphorus Control Plan (LPCP) for discharges to Baboosic Lake, as required by the 2017 MS4 Permit. LPCPs are a key compliance tool to reduce Phosphorus pollutant loads to local water bodies and improve water quality. The Permit requires towns that operate Municipal Separate Storm Sewer Systems (MS4s ) to complete LPCPs by June 30, 2023. The Region coordinated with the Hampshire Department of Environmental Services (NHDES) on this matter.
