Case summary

On July 8, 2026, EPA issued a Notice of Violation and Administrative Order on Consent ( NOV/AOC ) to Connecticut Propane & Petroleum, LLC and 21 Austin-HGB, LLC to improve chemical safety at the companies' propane distribution facility in Marlborough, Connecticut. An EPA inspection found the facility in violation of the Clean Air Act's General Duty Clause requirement to identify hazards by failing to conduct a Fire Safety Analysis that adequately considered risks, including the lack of a municipal water supply for fire suppression. The NOV/AOC will require the facility to update its Fire Safety Analysis to consider concerns identified by EPA. Clean Air Act Section 112(r) is a direct implementation program. EPA informed its state, local, and federal partners upon issuance of the NOV/AOC.
