Case summary

On March 18, 2026, EPA Region 1 settled an administrative penalty action against Tiverton Materials, LLC and Feeney Corp. ( Respondents ). EPA Region 1 is alleging that Respondents violated the New Source Performance Standards for Nonmetallic Mineral Processing Plants, Subpart OOO at the Tiverton, Rhode Island Facility by: (1) failing to timely submit notification of the actual date of startup; and (2) failing to timely conduct the required EPA Reference Method 9 visible emissions testing. Respondents have agreed to pay a $37,000 penalty and the settlement includes a statement that Respondents have corrected their violations and are currently in compliance with the Clean Air Act. The Rhode Island Department of Management ( RIDEM ) joined the inspection, and EPA shared a copy of the inspection report and the NOV with RIDEM. RIDEM does not have delegation of Subpart OOO for non-Title V facilities, and the Facility is not a Title V source.
