EPA v. BENEVENTO/AGGREGATE INDUSTRIES

Case summary

On January 15, 2026, EPA Region 1 issued a Notice of Violation and Administrative Order on Consent ( NOV/AOC ) to Benevento Family, L.P. and Benevento and Stone Corporation ( Respondents ) regarding alleged violations at Respondents' rock crushing facility in Wilmington, Massachusetts ( Facility ). EPA Region 1 is alleging that the Respondents violated the New Source Performance Standards ( NSPS ) for Nonmetallic Mineral Processing Plants, Subpart OOO, and the General Provisions of the NSPS, Subpart A, at its Facility by: (1) failing to timely submit notification of the actual date of startup; (2) failing to timely conduct the required EPA Reference Method 9 visible emissions testing; and (3) failing to conduct and document monthly inspections of the wet dust suppression systems and associated corrective actions. Respondents have agreed to come into compliance with all applicable requirements of Subpart OOO and will submit documentation of its compliance to EPA pursuant to the AOC. The Massachusetts Department of Environmental Protection ( MassDEP ) is not delegated to implement Subpart OOO for non-Title V operating permitted sources. Thus, EPA remains the authority for the implementation of Subpart OOO for these sources in Massachusetts. EPA has shared a copy of the NOV/AOC with the state.
