EPA v. COLLINS & AIKMAN PLANT

Final Order No Penalty

Case summary

On September 29, 2026, Region 1 signed an Administrative Settlement Agreement and Order on Consent (ASAOC) with McCord Corporation with respect to the Collins & Aikman Plant (Former) Superfund Site (Site), located in Farmington, NH. In the ASAOC, McCord agrees to perform a preliminary design investigation (PDI) to support a multi-phase extraction proposed remedial alternative, and as determined by EPA, a PDI for in-situ treatment. Between 1964 and 2006, Davidson Rubber Company (Davidson) under various names including Collins and Aikman, manufactured instrument panels, bumpers, fascias, and other automobile parts at the Site where solvents were released. The ASAOC follows a March 2025 partial summary judgment order by the U.S. District Court, which found McCord, a parent corporation of Davidson, liable as an operator under CERCLA. Litigation for costs, other than those covered for PDI under the ASAOC, remains ongoing. In 2013, EPA listed the Site on the National Priorities List.
